Fisher originally began this work as an examination of the constituional provision for suspending the Writ of Habeas Corpus, but found a need, based on the course of the war, to expand the essay to "a discussion of the nature of the Constitution itself, and of the powers which it does or must grant to the Government, over itself, and over the Union."
