First published in 1849, this was one of the earliest American treatises on the subject. The granting of patents in Anglo-American law has often been marked by confusion over their scope and intent. There has been much debate, for example, about whether patents create monopolies. Curtis argued that they do not according to the common law. Instead, a patent is a "grant by the government to the author of a new and useful invention, of the exclusive right, for a term of years, of practising that invention" (xxi). Best known as an expert on the U.S. Constitution, Curtis was a prominent New York patent attorney and the author of important works on admiralty law and equity jurisprudence.
